dc.description.abstract Most people in the rural areas of Thaba Nchu Stay in informal or tribal areas, which have not been planned or surveyed. These people have stayed in these areas for years but have no legal rights which they can claim to the land. The present government is obliged by the new policies to put in place mechanisms to improve security of tenure of the rural people. The purpose of this study was to investigate the preferred tenure system by the people in the rural areas of Thaba Nchu which would improve security of their residential tenure. Interviews with critical stakeholders could establish that the communal tenure system is the preferred tenure system in the area. It also established that registration of land rights may be possible in the area if the present administrative institutions can be restructured to ensure registration of communal land rights. en
